Welcome to Donarch Chocolates. By accessing our website and placing an order, you agree to be bound by the following terms and conditions. Please read them carefully.

1. General

These Terms & Conditions govern your use of the Donarch Chocolates website and the purchase of products from our online store and physical locations at 99 Northcote St, Kurri Kurri NSW 2327 and 49 Maize St, Tenambit NSW 2323. We reserve the right to update these terms at any time without prior notice.

2. Products & Pricing

All prices are listed in Australian Dollars (AUD) and include GST where applicable.
We make every effort to ensure product descriptions and images are accurate. However, slight variations in colour and appearance may occur due to photography and screen settings.
We reserve the right to modify prices, discontinue products, or limit quantities at any time without prior notice.
In the event of a pricing error, we will contact you before processing the order.

3. Orders & Payment

By placing an order, you are making an offer to purchase. We reserve the right to accept or decline any order.
Payment is required at the time of purchase. We accept major credit cards, debit cards, and other payment methods available at checkout via Shopify Payments.
You will receive an order confirmation email once your order has been placed. This does not constitute acceptance of your order — acceptance occurs when your order is dispatched.

4. Shipping & Delivery

We ship Australia-wide. Shipping costs and estimated delivery times are calculated at checkout.
Orders are typically dispatched within 1–2 business days.
During warmer months, we use insulated packaging to protect chocolate products during transit. However, we cannot guarantee that products will not be affected by extreme heat during delivery.
Risk of loss and damage passes to you upon delivery. Please inspect your order upon receipt.
Click and collect is available from our Kurri Kurri and Tenambit stores.

5. Returns & Refunds

Due to the perishable nature of our products, we cannot accept returns on food items unless they arrive damaged, defective, or incorrect.
If your order arrives damaged or incorrect, please contact us within 48 hours of delivery with photos of the issue.
Refunds will be processed to your original payment method within 5–10 business days once approved.
Non-perishable items (e.g. merchandise) may be returned in unused condition within 30 days for a refund or exchange.

6. Gift Cards

Gift cards are non-refundable and cannot be exchanged for cash.
Gift cards are valid for 3 years from the date of purchase, in accordance with Australian Consumer Law.
Lost or stolen gift cards cannot be replaced.

7. Intellectual Property

All content on this website — including text, images, logos, graphics, and design — is the property of Donarch Chocolates and is protected by Australian copyright and intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, Donarch Chocolates shall not be liable for any indirect, incidental, or consequential damages arising from your use of our website or products. Nothing in these terms excludes or limits any consumer guarantees under the Australian Consumer Law.

9. Privacy

Your use of our website is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information.

10. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
